In re: 2026 DCR 79 | 2026 FCR 56.
In this unusual appeal, the defendant below asked the Federal Court to grant attorney's fees after the district court dismissed without prejudice plaintiff's complaint over an issue with time zones. Judge Muggy21 quickly put the kibosh on that, holding that the dismissal was a non-final order, and neither party had truly prevailed.
